Self Help

·

Generally, before seeking legal advice, most people try to solve the problem themselves.  A practical solution is invariably better than ‘lawyering up’.  Self help is a legal remedy, recognised by the Courts, which permits a person to take his or her own actions to end a nuisance.  A typical example is the cutting of a neighbour’s encroaching branches or roots.  Great care is needed to ensure that one only does what is necessary– and no more – and that the method of abatement is reasonable in all the circumstances.
